After two years of many employees working remotely due to the pandemic, some workplaces are transitioning back to working in physical office spaces. However, many have learned to prefer remote working and the benefits that can come with it, so some are hesitant to return and want to know what rights they have surrounding this. While Nina states that there is no independent right that would allow an employee to work from home, there are some situations where it could be an employee rights concern.
For example, an employer cannot let a male employee work remotely while denying that same right to a female employee. Likewise, employers also need to consider employees with disabilities. If a disability, such as a compromised immune system, would prevent an employee from returning to a physical office space, the employer needs to provide a reasonable accommodation.
