Nina joined Robin Frederick, Deputy General Counsel and Senior Vice President at research and advisory company Gartner Inc. in Stamford, Connecticut, and Tamika Hardy, a partner at Rivkin Radler, LLP in Uniondale, New York to discuss the pandemic’s impact on women in the workplace. The panel was moderated by Maria John, Vice President and Associate General Counsel at The Related Companies, LP.
Nina spoke of discrimination claims made by women workers about facially neutral policies that, because of the pandemic, affect them disproportionately. She provided the example of employers who order all employees back to work, regardless of whether or not they have school-age children at home and no available childcare.
In addition to these seemingly neutral policies, Nina also discussed “unscrupulous employers” using the guise of financial hardship caused by the pandemic to lay off employees in protected classes (such as age, race, disability, gender, etc.) and employees who have engaged in protected activity by complaining about discrimination in the workplace.
