Garrison Law partner Nina Pirrotti was recently quoted in a Law360 article about the recent wave of proposed class action lawsuits involving pay transparency.
The article, entitled “Spate of Pay Range Suits has Wash. Employers ’Freaking Out,’” discusses concerns over Washington’s 2022 amendment to its Equal Pay and Opportunities Act, which went into effect Jan. 1, allowing job applicants or employees to sue individually, according to the state’s Department of Labor and Industries.
As quoted in the article, Nina points to ambiguities surrounding the law, stating, “Plaintiffs have the obligation to prove their damages to a reasonable degree of certainty, […] In cases where you’ve just been denied access to information, how do you prove damages?”
As for potential ‘trolls’ not seeking employment but rather violations of the law, Nina shares that one person applying to multiple jobs could just be conducting a regular job search, “You are job hunting, and here you are with this new law, and yet you’re in a situation where the postings that you’re seeing don’t comply. I most certainly see it that way too.”
